Terms of Service

Welcome to SwapChoice (the "Platform") ("we", "us", "our"). The Platform is a peer-to-peer barter and exchange service that allows users to list items or services for swap, propose trades, communicate, negotiate, and complete exchanges with other users.
These Terms of Service ("Terms") govern your access to and use of the Platform, including any content, functionality, and services offered on or through https://swapchoice.com. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform. If you are under this age, you may only use the Platform with permission and under supervision of a parent or legal guardian who agrees to these Terms.
1. Accounts and Registration
- You must create an account to use core features (listing, proposing swaps, messaging).
- You agree to provide accurate, current, and complete information during registration and to update it as needed.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- We reserve the right to suspend or terminate accounts for violations of these Terms, suspected fraud, or at our discretion.
2. User Content and Listings
You retain ownership of any content you post (listings, photos, descriptions, messages – "User Content"). By posting, you grant us a worldwide, non-exclusive, royalty-free license to display, host, and distribute it on the Platform as needed to operate the service.
You represent and warrant that:
- Your listings are accurate and describe items/services you actually own/control and can deliver.
- You will not post prohibited items (e.g., illegal goods, weapons, drugs, counterfeit items, hazardous materials – full list in Prohibited Activities below).
- Photos are yours or you have rights to use them; no misleading images.
3. Swaps, Proposals, and Transactions
SwapChoice is a venue only — we do not participate in, facilitate, or guarantee any barter transactions.
- All swaps are directly between users. You are solely responsible for negotiating terms, verifying item condition, arranging meetups/delivery, and completing exchanges.
- We do not hold items, verify identities beyond basic checks, or mediate value disputes unless safety/policy violations occur.
- Use caution when meeting in person; we recommend public places and never share sensitive personal/financial info.
- If optional cash top-ups are added later, they would be handled by third-party processors with separate terms.
4. Prohibited Activities
You may not:
- Use the Platform for illegal purposes or to trade prohibited items/services
- Impersonate others, create fake accounts, or spam
- Harass, threaten, discriminate against, or harm other users
- Post false/misleading listings or manipulate ratings/reviews
- Scrape, copy, or use bots to access the Platform
- Introduce viruses, malware, or attempt unauthorized access
5. Ratings, Reviews, and Conduct
After swaps, users may leave ratings/reviews. We may remove content that violates policy (e.g., spam, threats, personal info). We do not endorse or verify reviews.
6. Intellectual Property
The Platform (design, logos, code, text) is owned by us or our licensors. You get a limited license to use it for personal, non-commercial purposes per these Terms.
7. Disclaimers and Limitation of Liability
The Platform is provided "AS IS" without warranties of any kind. We do not guarantee:
- Accuracy/completeness of listings
- Safe, satisfactory, or successful swaps
- Continuous/uninterrupted access
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Platform, even if advised of the possibility.
8. Indemnification
You agree to indemnify and hold us harmless from claims, losses, liabilities, damages, costs (including attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.
9. Termination
We may suspend or terminate your access at any time for any reason, including violations. You may close your account anytime. Sections that by nature survive termination (e.g., liability, indemnification) remain in effect.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of Bulgaria, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the courts of Bulgaria. You agree to waive jury trial and class actions where permitted.
11. Changes to Terms
We may update these Terms. Changes will be posted here with a new "Last updated" date. Continued use after changes constitutes acceptance. Significant changes may include notice via email or in-app alert.
